Florida secures #3 spot for highest med mal claim rates, records 96 claims per 1,000 practitioners
A new study reveals Florida has the third highest medical malpractice claim rate in the United States.
The study, by Florida-based personal injury lawyers Anidjar & Levine, analyzed medical malpractice payment report data between 2020 and 2024 from the National Practitioner Data Bank (NPDB). By comparing the number of practitioners to respective malpractice claims, the research identified states that present the highest risk for medical malpractice incidents.
Florida ranks third, with 96 medical malpractice payment reports per 1,000 practitioners — 88% higher than the national average of 51. With a practitioner population of 58,361, the state recorded 5,608 medical malpractice payment reports over the five-year study period.
Looking at the study, a spokesperson from The Law Offices of Anidjar & Levine commented,
“According to the study, Florida reported the third highest medical malpractice claim rates in the United States.
“Medical malpractice claims in the United States don’t just represent medical errors, they indicate systemic problems that harm patients, burden healthcare systems, and strain medical resources. Affected patients and families face overwhelming grief along with medical bills and financial instability. These incidents create a chain reaction of hardships that extend far beyond the initial incident.
“To reduce these incidents, states need stronger oversight of medical practices, improved training programs, better reporting systems, and stronger patient safety initiatives. High-risk states, especially those with consistently elevated claim rates, require immediate intervention before more patients are harmed.”
